2. Your Privacy

2.1 This Privacy Policy applies to Floral Image owned and operated websites and its subdomains (“Websites”). Floral Image Pty Ltd (Floral Image, “we”, “us” or “our”) knows that you care how information about you is used and shared. We are committed to protecting your privacy as an online visitor to our Websites. This Privacy Policy intends to provide you with a general overview of where we are the data controller how we may process your personal information and your rights in relation to that information (referred to as “personal data”). The use of the information collected through our Websites shall be limited to the purposes under this Privacy Policy and Terms of Service to our customers.

2.2 By submitting personal data through any forms on this Websites, you are accepting this Privacy Policy and consenting to us using your personal data for the purposes mentioned below.

3. What personal data might we collect?

3.1 We may collect personally identifiable information about you, such as your full name, phone number, email address and business address. We only send very occasional promotional emails and service related emails related to your account. If you no longer wish to receive these emails, you may opt out of receiving them by clicking ‘unsubscribe’ which you will find in the footer of the email.

3.2 Your 'personal data' is any information about you that is capable of identifying you or being associated with you. We collect all different types of personal data for different reasons – this may include:

(a) Contact Information: Such as your name, job title, business address, telephone number, mobile number, fax number and email address.

(b) Payment data: Data necessary for us to process payments and implement fraud prevention measures, including credit/debit card numbers, security code numbers and other such relevant billing details.

(c) Business details: Business information which is necessary in order to provide our service to you.

(d) Preference: Information about your preferences where it is relevant to the services we provide.

(e) Platform details: Your password and other related log-in details for third party platforms maintained by Floral Image if you have access to.

3.3 Generally, if we are unable to collect the personal data we require we may not be able to provide you with the products and services you seek, or where the information is incorrect or incomplete, this may affect the quality of the service we provide to you.

4. When do we collect your personal data?

4.1 We may collect personal data about you in various cases, such as for example:

(a) When you or your organization use our service;

(b) When you or your organization request a free trial through our Websites; or

(c) When you or your organization make an inquiry through our Websites, in person, over email, via social media (e.g., Facebook, Instagram, Twitter, Snapchat), over the telephone or any third party communication apps (eg: WhatsApp, WeChat).

We will only provide you with such information via Electronic Direct Mail (EDMs) and emails; if you have opted in. You have the opportunity to opt-out of receiving any marketing and promotional communications at any time by clicking the ‘unsubscribe’ link which you will find in the footer of the email.

6. How we share your personal data?

6.1 We may share your personal data with our Floral Image affiliates and subsidiaries, for the purpose of assisting you with an inquiry. We may also disclose your personal data to our service providers for the purposes set out above, and for the purposes of those parties providing services to us or performing business services or functions.

6.2 We may share your personal data in the following circumstances:

(a) Between Floral Image Entities on a confidential basis where this is required for the purpose of providing services to you; or

(b) To any third party to whom we assign or novate any of our rights or obligations, including as part of business negotiations or transactions in connection with a proposed sale for divestiture of assets.

6.3 Otherwise, we will seek your consent prior to using or disclosing your personal data for another purpose, unless we are required or permitted by law to do so without seeking your permission.

7. Can you refuse to share your personal data with us?

7.1 In general, we receive your personal data where you provide this on a voluntary basis, and there will typically be no detrimental effect for you if you wish not to provide this or otherwise withhold your consent for it to be processed. However, this may restrict the way we can provide our products and services to you.

8. How do we keep your personal data safe?

8.1 We take appropriate technical and organizational measures to keep your person data confidential and secure, in accordance with our internal policies and procedures regarding storage of, access to and disclosure of personal data. We keep your personal data in our electronic systems or on paper files.

8.2 We will take reasonable steps to destroy or permanently de- identify your personal data when we no longer require it for any purpose for which it was collected. We may retain your personal data for as long as necessary to comply with any applicable law, for insurance and governance purposes.

9. Transfer of personal data abroad

9.1 Floral Image is active across the world – this means that we may transfer your personal data within Floral Image, including to countries other than where you reside. By using our Websites and providing your personal data to us you consent to us transferring your personal data to servers located abroad for the purpose of storage. Our Customer Relations Management (CRM) system is where we store your personal data. In certain cases, this may include transferring data to countries which may not offer the same level of protection as the laws of your country. All Entities and offices within Floral Image will ensure an adequate level of protection for your personal data at all times.

10. How long do we keep your personal data?

10.1 We delete or deidentify your personal data once it is no longer reasonably necessary for us to keep it for the purposes described in this Privacy Policy. Importantly, Floral Image will keep your data as necessary for the purpose of ensuring all accounts are paid and closed prior to the deletion of your personal data.

11. What rights do you have?

11.1 Subject to certain conditions under applicable legislation, you may have the right to:

(a) Request access to personal data that we hold about you, including details relating to the ways in which we collect, use, and share your data;

(b) Request a copy of the personal data which we hold about you;

(c) Be forgotten (request that all personal data we have to be deleted);

(d) Have any inaccurate data we hold about you corrected;

(e) Withdraw your consent;

(f) Opt out of certain uses of your personal data;

(g) Object or restrict our use of your personal data; and

(h) Submit a complaint if you have concerns about the way in which we are handling your data.

11.2 Such requests must be made in writing to us at the addresses listed in the Contact Us section of this Privacy Policy. To enable us to process your request, we may require that you provide us with proof of your identity, such as providing us with a copy of a valid form of identification – that is to ensure we appropriately protect the personal data we hold from unauthorized access requests and comply with our security obligations.

12. Children’s personal data

12.1 Our Websites are not intended or designed to attract users under the age of 13 or to collect personal data from such users. We do not knowingly collect personal data from individuals under 13 and individuals under the age of 13 should not submit any personal data through our Websites.

13.3 Our Websites may also include social media features. These features are usually recognizable by their third-party brand or logo and may collect your IP address, which page you are visiting on our Websites, and set a cookie to enable the feature to work properly. Social media features and widgets are either hosted by a third party or hosted directly on our Websites. Your interactions with these features are governed by the privacy policy of the company providing it. 13.8 Some internet browsers have “Do Not Track” or “DNT” features which, when turned on, send a signal to a website that the individual visiting the website does not wish to be tracked. 15.1 We have the right to update the contents of this Privacy Policy from time to time to reflect any changes in the way in which we process your personal data or to reflect legal requirements as these may change. Changes will take effect as soon as the revised version is made available on our Websites.

15.2 We reserve the right to amend or replace this Privacy Policy at any time. You should review our current Privacy Policy each time you provide us with personal data and when you visit our Websites.
